A Fairfield man has pleaded not guilty to a charge of lascivious acts with a child stemming from an incident in late April.
Timothy Sebastian Chavez, 21, was arrested April 20 and charged with lascivious acts with a 13-year-old girl. According to an arrest report from the Fairfield Police Department, officers were notified by the 13-year-old’s mother that her daughter had been at a party and that the mother was looking for her. The mother reported that, while searching for her, she found her daughter behind Boom Fitness, naked, with a man on top of her who was also naked. The mother told police that the man put his clothes on and ran away.
Officers spoke to the girl, who said she had been drinking, blacked out, and did not remember what happened. Officers spoke to another witness who gave the same account of events as the mother. Officers checked the area in search of the man, whom they located laying by the railroad tracks in an attempt to hide. According to the arrest report, the man was apprehended after a short foot chase. Both witnesses picked the defendant out of a photo lineup as the man who was naked on top of the girl.
In a written arraignment filed May 10, Chavez pleaded not guilty to the charge, and demanded a speedy trial within 90 days. Pre-trial conference was set for May 28, with a jury trial scheduled for June 4.
